Can I File My Taxes Without My Social Security Card

Valid Social Security Number

Should I Opt-Out of Paying Into Social Security?

To claim the EIC, you, your spouse , and any qualifying child listed on Schedule EIC must have a valid Social Security Number by the due date of your 2015 return.

If your social security card says Not valid for employment and your Social Security Number was issued so that you could get a federally funded benefit, you cannot get the EIC.

  • An example of a federally funded benefit is Medicaid. If you have a card with the legend Not valid for employment and your immigration status has changed so that you are now a U.S. citizen or permanent resident, ask the Social Security Administration for a new social security card without the legend.

Possible Scenarios

  • U.S. citizen. If you were a U.S. citizen when you received your Social Security Number, you have a valid Social Security Number.
  • Valid for work only with INS authorization or DHS authorization. If your social security card reads Valid for work only with INS authorization or Valid for work only with DHS authorization, you have a valid Social Security Number, but only if that authorization is still valid.
  • Social Security Number missing or incorrect.
  • If an Social Security Number for you or your spouse is missing from your tax return or is incorrect, you may not get the EIC.
  • Other taxpayer identification number. You cannot get the EIC if, instead of an Social Security Number, you have an individual taxpayer identification number . ITINs are issued by the Internal Revenue Service to non-citizens who cannot get an SSN.
  • Your Clients Can Get A W

If you are working with a client who receives Social Security benefits, remember that they have the option of federal income tax being withheld from their benefits at the rate of 7, 10, 12, or 22 percent. Encourage them to sign and submit IRS Form W-4V directly to their local Social Security office.

This same form can be used to stop withholding federal income tax from their benefits. Taxes will be paid directly to the Internal Revenue Service and will be shown on their form SSA-1099 the following tax season.

What Can I Do With An Itin

ITINs are strictly used as a taxpayer identification number, so people without an SSN can file a tax return. The IRS makes it clear that an ITIN does not

    • Provide authorization to work in the U.S.
    • Impact your immigration status, or
    • Qualify you for benefits like Social Security or tax breaks like the Earned Income Tax Credit

What Are Individual Taxpayer Identification Numbers

Undocumented workers have another option: the Individual Taxpayer Identification Number . An ITIN can be used in place of an SSN. The IRS created the ITIN back in 1996 to encourage those who are ineligible for an SSN to file returns and pay taxes.

An ITIN is not an authorization to work in the United States, however. Receiving one doesnt mean that youre a documented alien or resident. It simply allows you to file a tax return and pay taxes.

2 Ways to File For Your Married Name on Your Social ...

To file tax forms and claim treaty benefits, the IRS requires a nonresident alien to have either a Social Security Number or an Individual Taxpayer Identification Number .

These are not the same as a national ID number. SSNs and ITINs do not represent permission to work and are not proof of U.S. citizenship or Lawful Permanent Residence.

It is important to keep your SSN or ITIN confidential to protect your identity. Tax-related identity theft occurs when someone uses your stolen SSN or ITIN to file a fraudulent tax return in your name and claim a refund. Visit the IRS website to learn more about tax-related identity theft.

What Is An Independent Taxpayer Id Number

An ITIN is a 9-digit processing number issued for tax purposes. Each ITIN begins with the number 9, and its formatting is similar to an SSN . But unlike SSNs, which are issued by the Social Security Administration, ITINs are issued by the IRS. The IRS issues ITINs regardless of a recipients immigration status.

    Individual Taxpayer Id Number

An Individual Taxpayer ID Number may be required for individuals who do not have employment authorization and are not eligible for an SSN. ITINs are issued only for the purpose of federal tax reporting. Nonresidents filing an income tax return may need an ITIN.

An ITIN is not required to complete a Form 8843.

An ITIN does not entitle the recipient to Social Security benefits, indicate immigration status, or guarantee/certify the right to work in the U.S.

In order to receive an ITIN you must complete Form W-7 with the IRS. Visit the IRS website to learn more about ITINs.

The tax preparation software provided for international scholars will automatically generate Form W-7 for nonresident aliens who require ITINs for their dependents in order to claim them on their tax returns.

Once you have completed the documents, you can make an appointment at the IRS Taxpayer Assistance Center to submit your application along with your proof of identity and foreign status documents.

Did Someone Steal Your Social Security Number to File Taxes? Here’s What to Do

You might be thinking, âWhy bother to file for bankruptcy if Iâm judgment proof?â You might be judgment proof, but it still may be to your benefit to file for bankruptcy anyway. Consider that you may be judgment proof today, but not tomorrow. For example, what if you decide to go back to work part-time while still collecting disability benefits? The money earned from your job could be garnished. Also, creditors use pressure tactics to try to settle a case, which means there is no doubt theyâll continue contacting you. While creditors and collection agencies have to comply with the Fair Debt Collection Practices Act when it comes to collections, thereâs a lot to be said for peace of mind and ending creditor calls and communications by filing for bankruptcy.

Who Can Get A Social Security Number

A Social Security number serves many purposes. Its used as an identification number by your employer when reporting federal and state income and payroll taxes withheld, for instance. Its also used to open a bank account with a U.S. financial institution, apply for federal loans or certain types of public assistance, enroll in Medicare and to get a drivers license.

Having a Social Security Number is also essential for establishing a credit score in the U.S. Without a SSN, it can be challenging to build credit and take out loans if you need them for major purchases.

If you, your spouse or a dependent qualify for an SSN, you should file Form SS5, Application for a Social Security Card, with the Social Security Administration .

According to the SSA, generally only non-citizens authorized to work in the U.S. by the Department of Homeland Security can get a Social Security number. To do this, you can either apply for a SSN in your home country before coming to the U.S. or visit a Social Security office in person.

If you choose to take care of this process in your home country, youll need to file for a SSN when filing your application for an immigrant visa with the U.S. Department of State.

If visiting a Social Security office in person, youll need to show documentation to prove your identity and work-authorized immigration status. This documentation might include:

Protect Your Information From Scammers Online And On Your Phone

If you use tax preparation software like TurboTax, TaxAct, or TaxSlayer, use multi-factor authentication. Multi-factor authentication offers extra security by requiring two or more credentials to log in to your account. The additional credentials you need to log in to your account fall into two categories: something you have like a passcode you get via text message or an authentication app, or something you are like a scan of your fingerprint, your retina, or your face. Multi-factor authentication makes it harder for scammers to log in to your accounts if they do get your username and password.

Dont give your personal information to someone who calls, emails, or texts and says theyre with the IRS. It could be a scammer impersonating the IRS to steal your information or money. If you need to contact the IRS, call them at 1-800-829-1040.

    Resident And Nonresident Aliens

How you claim a non-citizen spouse to your tax return depends on your spouse’s residency status. Your spouse will be either a “resident alien” or a “nonresident alien.” Usually, there are two ways to tell whether a non-citizen qualifies as a resident alien:

    • The non-citizen has a “green card,” which is authorization from the federal government to live and work in the United States permanently. The IRS refers to this as the “green card test.”
    • The non-citizen was in the United States for at least 31 days of the year, and at least 183 days during the three-year period that includes the current year and the two years immediately before that. The IRS calls this the “substantial presence test.” Learn more about how to properly count those 183 days with TurboTax’s Tax Tips for Resident and Non-Resident Aliens.

Anyone who doesn’t qualify as a resident alien is considered a nonresident alien.

    What Is Judgment Proof

There are two major phases of a lawsuit filed against you by a creditor. The first phase is the creditor getting a judgment against you. The next phase is the creditor proceeding to collect on the judgment.

If you have no assets or income, or your only income is Social Security benefits, then youâre judgment proof. This means almost all creditors have no way of collecting on the debt. Note that being judgment proof doesnât mean that a creditor wonât sue you, it just means they have no way of collecting the debt that is owed.

    Less Drastic Secure Options

Unless youre concerned that your identity is imminently at risk for theft, locking your number through your Social Security online account might not be necessary.

Here are 4 essential practices to protect your Social Security number and keep it secure:

  • Shred any paperwork that includes your number before throwing it away
  • Make sure your computers anti-virus software is up to date
  • Dont invite trouble by using open Wi-Fi networks
  • Be very suspicious of anyone who asks for your SSN, whether over the phone or by email
  • You might be asked to provide your Social Security account when you apply for certain services or when you seek medical care. You can decline to give your number, but the provider can then choose to deny you service.

Before you provide your Social Security number, ask a few questions to help you decide whether that makes sense:

    • Why do they need your number?
    • How will it be stored?
    • Will it be shared with other companies?
