Gathering The Documents Needed To Change Your Ssa Card

As mentioned, the first step in updating your Social Security card is to gather documentation to prove:

  • Your name change
  • Your identity
  • Your citizenship or legal residence
  • To prove that youve legally changed your name, youll need to provide a certified copy of one of the following documents:

    • Certificate of naturalization
    • Divorce decree

Its possible that one of these documents could provide enough information for the SSA to verify your identity, but if it doesnt, youll need to submit another document to prove your identity. To prove your identity, all of the following documentation may be accepted:

    • United States passport
    • U.S. drivers license
    • State-issued ID card

To prove your prior name, any of the above documents will be acceptedeven if theyre expiredas long as they match your name in the SSAs records. If you dont have an ID document with your prior name, you can use an ID document with your current name as long as the SSA can verify your identity in their records. Finally, if you do not have a passport, license, or state-issued ID card and you cant get one within ten days, you can use one of the following documents:

    • Health insurance card
    • School I.D. card
    • U.S. military identification
    • Employee I.D. card

How Does Social Security Treat Marriages Involving Transgender People

Can You Change Your Social Security Number After Identity ...

Social Security recognizes as valid any marriage that was recognized under state law as being a valid marriage when it was entered into. Social Security looks to state law and government-issued documents to determine marital status it is not based on the gender marker in your Social Security record. For this reason, changing your gender marker with Social Security will not affect your or your spouses right to Social Security benefits. Any marriage that was valid when it was entered continues to be valid regardless of a spouses transition.

What Happens When You Withdraw Your Application

There are a few things to know before deciding to withdraw your application.

    • Anyone else who receives benefits based on your application must consent in writing to the withdrawal.
    • You must repay all the benefits you and your family received from your retirement application. This includes:
      • Benefits your spouse or children received, whether they live with you or not.
      • Money withheld from your Social Security retirement checks for:
        • Medicare Part B, Part C, and Part D premiums.
        • Voluntary tax withholding of federal income taxes for closed tax years. Contact the Internal Revenue Service or your tax advisor about any tax implications.
        • Garnishments.
    • If you are already entitled to Medicare, you may choose to also withdraw your Medicare coverage.
    • If you are also entitled to railroad or veterans benefits, you should check with the Railroad Retirement Board and the Department of Veterans Affairs about how your withdrawal affects those benefits. The RRB and the VA make their own determinations and are responsible for their own programs.

One Number Is Issued To Two Different People

You may be wondering, if Social Security numbers are unique to each person, how could two people have the same number assigned to them?

There are the exceptional times when the SSA issues the same number to two people as happened to two women in Florida. Both women were born on the same day and given nearly identical names. Add to the confusion two hospitals created the same birth record resulting in 25 years of tribulations for the two.

The Social Security Administration Allows People To Change Their Social Security Number But Only In Very Limited Situations And Youll Need Document Why

Social Security numbers are an omnipresent part of life and meant to be unique to each holder and be kept for life. There are times though that a person may want to change the number assigned to them by the Social Security Administration .

The process is not easy and will require that an individual provide proof that the change is necessary due to the problems their original number is causing them or the harm that may come to them if a change isnt made.

Why Victims Want To Change Their Social Security Number

HOW TO: Change Your Name & Gender Legally (Social Security)

The most difficult cases of identity theft to resolve are typically ones involving non-financial aspects of a persons life. There are a fairly robust set of mechanisms in place, like credit freezes, to stop an identity thief from wreaking too much havoc on a persons finances, but its much more difficult to stop medical, governmental, or criminal identity theft.

Criminal identity theft is when a thief uses a victims name or identity in the commission of a crime. Weve seen the gamut, from people finding out that they have traffic violations under their name that they werent aware of. Weve also seen where someone has a felony warrant , says Velasquez, whose organization runs a counseling service for identity-theft victims. We even know of people who have had to deal with a person being incarcerated .

Even in cases of criminal or medical identity theftthe latter of which a survey by the Ponemon Institute found took victims an average of $13,500 and 200 hours to adequately rectifygetting a new Social Security number isnt guaranteed to make someones identity theft problems go away. In fact, it could create a whole new set of headaches.

Changing Your Social Security Number Is Not A Guaranteed Fix

Even if you are granted a new Social Security number, your problems may not instantly evaporate. Your old information is still out there, after all. Please keep in mind that a new number may not guarantee a fresh start because other governmental agencies and private businesses will have records under your old number, Jarrett says.

Most people who are asking us for it have had a persistent case of identity theft where it continues to crop up over a period of time.

Furthermore, obtaining a new Social Security number is not possible if youre trying to fix financial woes for which you are responsible, says Jarrett. You cannot get a new SSN to avoid the consequences of filing for bankruptcy, to avoid the law or your legal responsibility, or if there is no evidence that someone is using your number, he says.

Eva Velasquez, president of the Identity Theft Resource Center, notes that identity-theft victims often ask her about getting a new SSN, but its not really a viable option for most of them. In her experience, the Social Security Administration appears to deny most peoples requests for new numbers.

While the agency doesnt keep track of the number of applications for new Social Security numbers, only 250 were granted during all of last year.

Identity Theft That Is Continuing To Cause Hardship

By itself, identity theft is not a singular reason that the SSA will issue a new number. Continued hardship by using the original Social Security number must be proven. Also a person must demonstrate that they have exhausted all possible means to solve the problem.

A victim of identity theft has to show with documents from third parties that their number is being used for fraudulent transactions. As well that that use is causing ongoing harm such as loans being denied or their credit rating is being adversely affected. The SSA provides a guide for victims of identity theft.

Why Service Canada Does Not Issue New Social Insurance Numbers For Those Affected By A Data Breach

  • A new Social Insurance Number does not protect you from fraud and identity theft.

A new Social Insurance Number is not a fresh start or protection from fraud or identity theft.

If someone else uses your old Social Insurance Number and the business does not check the persons identity, you may have to prove you were not involved in the fraud or pay the impostors debts.

  • A new Social Insurance Number is a complex affair.

The Government can only share your new Social Insurance Number with the federal departments and agencies that use your Social Insurance Number.

This means that it would be up to you to provide your new Social Insurance Number to all the financial institutions, creditors, pension providers, recent and current employers, and any other organizations with which you shared your old Social Insurance Number.

Not doing or failing to do so properly risks not receiving benefits or leaves the door open to subsequent fraud or identity theft.

  • You double your monitoring efforts with two Social Insurance Numbers instead of one.

A new Social Insurance Number does not erase your old Social Insurance Number. You would therefore need to monitor your accounts and credit reports for both Social Insurance Numbers on a regular and ongoing basis. This would put burden on you. Numerous Social Insurance Numbers multiply the risk of fraud.

What If I Change My Mind About When To Begin Social Security Benefits

You have a limited opportunity to change your mind after you’ve applied for benefits. You can complete Form SSA-521, Request for Withdrawal of Application, and reapply at a later date. But if you’re already receiving benefits, you can only withdraw your claim if it has been less than 12 months since you first became entitled to benefits, and you’re limited to one withdrawal per lifetime. In addition, there are financial consequences–you must repay all benefits already paid to you or your family members based on your application, as well as any money withheld from your checks, including Medicare premiums, or tax withholding.
