Important

Social Security must verify a birth record for all U.S.-born applicants who apply for an original SSN. An exception is made for a parent who applies for a baby’s SSN at the hospital when the baby is born. To verify a birth record, we will contact the office that issued it.

All documents must be either originals or copies certified by the issuing agency. We cannot accept photocopies or notarized copies of documents. We also cannot accept a receipt showing you applied for the document.

Get a certified copy of a document showing a birth, marriage or divorce that took place in the United States.

Original Card For A Noncitizen Child

In general, only noncitizens who have permission to work from the Department of Homeland Security can apply for a Social Security number . If your child does not have permission to work but needs an SSN for other purposes, see “If your child does not have permission to work” for further information.

Enumeration Beyond Entry

You may be eligible to apply using our automated process called Enumeration Beyond Entry if you are applying to the United States Citizenship and Immigration Services for work authorization or lawful permanent resident status.

If you are unable to use Form I-765 or Form I-485, you will need to contact your local Social Security field office. You should receive your SSN card within two weeks after we have everything we need to process your application, including verification of your immigration document with the USCIS. If we are unable to immediately verify your immigration document with the USCIS, it may take two additional weeks to receive your card.

Changing Name And Gender Marker In A Different County From One’s County Of Residence

The Family Code says “An adult may file a petition requesting a change of name in the county of the adult’s place of residence.” Note the law uses the word “may”. If one “may” perform an act, it is permissive, which suggest that they “may” also file somewhere else. This is a standard rule used when interpreting statutory language.

However, as the statute does not mandate that name change be allowed anywhere, a judge can deny a name change/gender marker change petition on the grounds that the petitioner lives in a different county.

So what to do if you run into this problem? Rule #1 be polite to everyone in the courthouse without exception.

If the person telling you that you can’t file the name change is in the clerks office, VERY POLITELY ASK they that accept your filing and allow you to present your request the judge to consider your petition.

If the person telling you that you must file the name change in your home county is in the Courtroom, or is on the Judge’s staff, very politely point them to the language of 45.101 and note that it is permissive and ASK them to allow you to present your petition . If they say no, thank them and ask that your case be continued and retained and try again in a week or two.

What Do I Do After I Get A Court Order

Getting a court order does not automatically change your name or gender marker. You must then apply to have each one of your IDs and all your information updated. Information about changing specific IDs is below.

Getting a court order isnt a perfect guarantee that everyone will immediately update your information. You shouldnt have any issues with the standard government IDs listed below, but if you have issues getting other information updated you can ask an attorney for more help.

Its usually best to update Social Security first, because other government agencies will often check your information with Social Security. However, you can update your IDs in whatever order youd like. You usually have to show other IDs regardless of which ID youre updating, and chances are some of those wont be updated with your new name or gender marker yet. Thats fine, because the court order is proof of your legal name and/or gender marker change.

There may be some IDs you cant update, or you may not want to update some of your IDs because you dont really use them, they cost too much, its too difficult, or some other reason. Its usually easier when all of your IDs match, but it should be okay if some dont. You should always keep a copy of your court order to prove youre the same person listed on mismatched IDs, and you can ask an attorney for more help if you have any issues.

How Do I Update My Health Insurance

If you get Medicare or Medicaid, then the gender marker listed on your insurance may be changed when you update Social Security. Otherwise, you can contact your Medicare or Medicaid provider, or other private insurance provider, about updating your name and gender marker.

Your health insurance should provide the same coverage regardless of your gender marker. However, sometimes insurance companies wont pay for care when they think your gender marker doesnt match with the services you received. You should work with your provider or contact your plan to try to fix the denial. You can also ask an attorney for advice or more help. Many people wish to change their name after they get divorced, in the case where they have taken the name of their now-divorced spouse. Those interested in reverting back to their maiden name only need to include a clause in the divorce petition stating their desire to do so. The court can order the name change within the divorce decree, as long as they are certain you are not changing your name to avoid criminal prosecution or debt collectors. The divorce decree is proof of your legal name change you can use it to update your name on all your accounts, licenses, and ID cards.

Change Your Name With The Ssa

When you’ve legally changed your name, you must report your new name to the Social Security Administration before changing your name with the Texas DMV and DPS.

You can only change your name in person or by mail. You cannot change your name online.

You will need:

  • Proof of your U.S. citizenship, such as your:
  • U.S. birth certificate.
  • Certificate of citizenship.
  • Certificate of naturalization.

    What Documents Do You Need

    To get the actual name change process rolling, you’ll need to fill out two forms: the Original Petition for Change of Name and the Order Granting Change of Name of Adult. You can get these forms from your local county court. The first form is the one that you’ll use to apply for your name change. The second is the one the judge will sign once your name change has been granted. It’s important that the information on both forms is exactly the same in order to change your name.

    How Do I Update With A Name Change Only For A Us Passport

    If you only changed your name and not your gender marker, the process for updating a passport can be different. If its been less than a year since you got your passport, you will apply by mail. You will need:

    • Form DS-5504
    • Your most recent U.S. Passport
    • Your court order for name change, and
    • Once color passport photo.

    You should not have to pay any fees unless you ask for expedited service. You MUST send your documents by USPS to the address listed on Form DS-5504. Other companies cannot deliver to the P.O. Box.

    If its been more than a year since got your passport, you might be able to renew your passport by mail using Form DS-82. You must submit your most recent passport with your application, and the passport must:

    • be in good condition ,
    • have been issued when you were 16 or older, and

    If youve already changed your Texas drivers license or state ID, you may have updated your voter registration at the same time. You can check your registration information here.

    NOTE: Jury wheels in Texas are made up of two listsa list of registered voters and a list of U.S. citizens, 18 or older, who have a valid Texas drivers license or non-drivers ID. Unless you are exempt from jury service, your old name may remain on the jury wheel and you may receive a summons under your old name until you update both your drivers license/state ID and voter registration. The jury wheel is only updated once per year, so you may receive a summons under your old name if youre called before the wheel gets updated.

    How Do I Update A Deed For Real Property

    If you owned land or a home before your name change, the title will be under your old name. It is hard to change a deed in Texas, although you may not need to change yours. You should keep a copy of your court order in case you need to prove that you are the person listed in the deed. However, if your deed stays under your old name you may continue to receive property tax bills under your old name.

    To change your deed, you would likely need to have a new deed prepared transferring the property from yourself under your old name, to yourself under your new name.
