Step 1: Be in the U.S. for 10 Days with ‘Active’ Record
If you are in F-1, H-1B or J-1 status, the data that confirms your status and the fact that you are eligible for a Social Security Number has to be accessed on-line by the agent of the Social Security Administration at the time you apply. The data will not travel from the Immigration Service to the SSA database until two conditions apply:
Restrictions On Governmental Collection And Use Of Ssns
As early as the 1970s, concerns regarding increased uses of the SSN by both government and private entities prompted studies and subsequent congressional action limiting government uses of the SSN. The Social Security Administration created a task force in 1970 to investigate “non-program” uses of the SSN, and the task force’s report the following year stated,
Any examination of SSN policy must begin with the recognition that the number has ceased to be merely a “social security number.” Especially in the past few years, the number has come into increasingly wide use as a numerical identifier throughout society, to the point where the adult American citizen is beginning to need a number to function effectively even if he is among the very small minority of people who never work in covered employment.44
In 1973, the Department of Health, Education and Welfare Secretary’s Advisory Committee on Automated Personal Data Systems proposed that an individual whose SSN is requested should be informed as to whether or not divulging his number is legally required and that no individual should be denied a benefit because of his refusal to divulge his SSN for purposes other than those required by federal law.45
Use Required For Federal Tax Purposes
Internal Revenue Code section 6109 provides: “The social security account number issued to an individual for purposes of section 205 of the Social Security Act shall, except as shall otherwise be specified under regulations of the Secretary , be used as the identifying number for such individual for purposes of this title .”
The Internal Revenue Code also provides, when required by regulations prescribed by the secretary of the treasury or their delegate:
- Inclusion in returns: Any person required under the authority of this title to make a return, statement, or other document shall include in such return, statement, or other document such identifying number as may be prescribed for securing proper identification of such person.
- Furnishing number to other persons: Any person with respect to whom a return, statement, or other document is required under the authority of this title to be made by another person or whose identifying number is required to be shown on a return of another person shall furnish to such other person such identifying number as may be prescribed for securing their proper identification.
According to U.S. Treasury regulations, any person who, after October 31, 1962, works as an employee for wages subject to Social Security taxes, Medicare taxes, or U.S. federal income tax withholdings is required to apply for “an account number” using Form SS-5.

Applying For A New Number Or Replacement Card
The SSA may assign a new Social Security number to you if you are being harassed, abused, or are in grave danger when using the original number, or if you can prove that someone has stolen your number and is using it. You must provide evidence that the number is being misused, and that the misuse is causing you significant continuing harm.
If you apply for a new Social Security number, you must prove
- your age
- your citizenship or lawful immigration status
- your identity
Getting a new Social Security number probably wont resolve all the problems related to the theft of your identity. Government agencies and some businesses may keep records under your original Social Security number. In addition, because credit reporting companies use Social Security numbers and other personal information to identify a persons credit file, using a new number doesnt guarantee a fresh start. But by being careful with your personal information and monitoring credit reports for fraudulent activity, you can limit the misuse.
The SSA lets you apply for an original Social Security number or a replacement Social Security card for free. The application form and information about the supporting documents you need to apply are available online. The form takes just a few minutes to complete. But that hasnt stopped some websites from claiming that the process is complicated, confusing, and time-consuming, and offering to do it for you for a fee.
Obtain Proof Of Employment Eligibility
To be eligible for an SSN, you must provide proof of employment to the Social Security Administration. You must have this documentation in hand before you apply for an SSN. The type of proof varies with the type of work authorization you have:

Contact the authorizing agency directly to find out why they sent the payment. You may be able to find the authorizing agency in the memo line of the check. The monthly Social Security benefit you’ll be entitled to in retirement is based on your wage history — specifically, your 35 highest-paid years of earnings throughout your career. And you’re entitled to that benefit once you reach full retirement age, or FRA.
You’re allowed to file for Social Security before FRA, but doing so has consequences — namely, that you’ll slash your monthly benefit for life. And you can also claim Social Security after FRA for an increased benefit. But if you don’t know your FRA, it’ll be difficult to put together a well-thought-out filing strategy.

Now, let’s say you decide to enroll in Medicare at age 65, which is when eligibility kicks in. You may be tempted to sign up for Social Security at the same time. That way, you can not only start collecting that money, but also avoid the hassle of having to pay your Medicare premiums, since they get deducted from Social Security payments once you begin receiving them.
But if you were born in 1960 or later, filing at age 65 means claiming benefits two years ahead of FRA. And that means you’ll reduce your benefits by about 13.34% if you go that route.
In fact, the earliest age you can claim Social Security is 62. But if you file at age 62 with a FRA of 67, your benefits will suffer a 30% hit.

The Social Security Number: Legal Developments Affecting Its Collection Disclosure And Confidentiality
While the social security number was first introduced as a device for keeping track of contributions to the Social Security program, its use has been expanded by government entities and the private sector to keep track of many other government and private sector records. Use of the SSN as a federal government identifier was based on Executive Order 9397, issued by President Franklin Roosevelt. Beginning in the 1960s, federal agencies started adopting the SSN as a governmental identifier, and its use for keeping track of government records, on both the federal and state levels, greatly increased.
Section 7 of the Privacy Act of 1974 provided some limits on compulsory divulgence of the social security number to government entities. However, exceptions in that statute and succeeding statutes resulted in only minimal restrictions on governmental usage of the SSN. Today, an individual needs an SSN to pay taxes, obtain a driverâs license, and open a bank account, among other things. The continued use of, and reliance on, SSNs by public and private sector entities and the potential for SSN misuse, including identity theft concerns, has led to increasing efforts by governmental entities to limit the use and disclosure of SSNs. However, no single federal law comprehensively regulates SSN collection and confidentiality.
Obtain A Receipt Wait For Your Ssn Card
Anyone applying for a Social Security Number will receive a “receipt,” consisting of a form letter confirming that you have submitted an application. There are three different versions of this receipt, depending on circumstances:
- Your application is accepted and will take 10-14 days
- Your application is under processing and may take 1-3 months for review
- Your application has been rejected

The Social Security Administration, due to the pandemic, does not currently allow individuals to walk-in to submit their SSN application. Students should request an SSN Letter from the ISO by logging in to iMIT, select the left-hand menu Student Services based on your visa status, and complete the eform for SSN Letter Request.Once students receive their ISO support letter for the SSN, the ISO will also notify the SSA Office in Cambridge of the students name and phone number SSA will then call the student within 1-2 weeks to schedule an appointment time for the student to submit the SSN application in person at the SSA Office. It is not possible to submit the SSN application at the SSA Office without a scheduled appointment. NOTE: Students working on-campus at MIT can complete their Form I-9 Employment Eligibility Verification at the MIT Atlas Center before they receive their SSN, but will need to provide their SSN to the Atlas Center once the SSN is received.

Ssns Used In Advertising
Some SSNs used in advertising have rendered those numbers invalid. One famous instance of this occurred in 1938 when the E. H. Ferree Company in Lockport, New York, decided to promote its product by showing how a Social Security card would fit into its wallets. A sample card, used for display purposes, was placed in each wallet, which was sold by Woolworth and other department stores across the country the wallet manufacturer’s vice president and treasurer Douglas Patterson used the actual SSN of his secretary, Hilda Schrader Whitcher.
Even though the card was printed in red and had “specimen” printed across the front, many people used Whitcher’s SSN as their own. The Social Security Administration’s account of the incident also claims that the fake card was half the size of a real card, despite a miniature card being useless for its purpose and despite Whitcher’s holding two cards of apparently identical size in the accompanying photograph. Over time, the number that appeared has been claimed by a total of over 40,000 people as their own. The SSA initiated an advertising campaign stating that it was incorrect to use the number . However, the number was found to be in use by 12 individuals as late as 1977.
The First Social Security Number And The Lowest Number
The first SSN issued was not the lowest number, and the lowest number was not the first SSN. In fact, the first number issued wasn’t really the first number issued at all.The “First” Social Security Number
Issued Through Local Post Offices
So the first card was issued, sometime in mid-November, 1936, somewhere in one of 1,074 post offices to someone whose identity and SSN are unknown. In theory, the first card should have been issued on November 24th, but there have been reports of cards showing earlier dates. It is not clear whether the cards with earlier dates were actually issued on that day or whether some post offices predated some of their cards. If the 45,000 local post offices followed their procedures, no cards could have been issued before November 16th, and none should have been issued before November 24th. But here again, there is always the possibility that some local post offices failed to follow their instructions. The best we can say with certainty is that the first SSN was issued sometime in mid-November 1936. In any case, on whatever day the first card was issued, hundreds of thousands of SSNs were probably issued on that same day, so many people had Social Security cards issued on the very first day they became available.
